Are Delaware County Court Records Public?

What Information is Available in Delaware County Court Records?

Online Access

In-person Access

Copies of Delaware County court records can be obtained from the clerk's office on Mondays through Fridays between 8:30 a.m. and 4:00 p.m. In-person requesters are to fill out a Request for Copies of Court Record Form and submit it to the clerk's office in person. While copies of court records are provided at a cost, inspection of records is usually free of charge.

Mail and Phone Requests

Requests for copies of court records can also be mailed to the clerk's office. The mail is to contain a completed request form, a self-addressed stamped envelope, and money orders or cashier's checks made payable to the "Clerk of Delaware County". Mails can be sent to:

Fees for Court Records in Delaware County

The Clerk of the Circuit Court in Delaware County is the official custodian of court records produced by the county courts. The clerk's office allows for the free inspection of court records at the courthouse within business hours. However, state law directs the clerk's office to provide copies of court records to the public at $1 per page and $3 per document for certification (Indiana Code 33-37-5-1 and 33-37-5-3).

Criminal Records Access in Delaware County

The Indiana State Police (ISP) oversees state-level criminal history checks for Delaware County instead of the county courts. The ISP provides limited criminal history searches to subscribers at $15 per search.

The Delaware County Sheriff's Office offers citizens limited criminal history checks for a fee of $10 per search. In addition, criminal court case records are available at the clerk of the circuit court's office for viewing and copying. Delaware County Probate Records

Probate records consist of case files, documents, and other materials filed or created during a probate court process. Delaware County probate records include wills, trusts, estate administration, name change, guardianship, dependent care, and conservatorship. The Clerk of the Circuit Court maintains records of probate cases heard within county limits and offers them to the public on request.

These records contain confidential information capable of violating the subject's privacy if disclosed and may not be available online.

Requesters can make inquiries about family court records in person at the clerk's office. The clerk's office may only release certain information and certified copies to record subjects, immediate family members, or legally eligible individuals. Certified copies may be obtained from the clerk's office for $3 per copy plus copy fees
